(a) Public interest. The Head of the Agency may conclude that the national preference would be inconsistent with the public interest. This exception applies if an agency has an agreement with a foreign government that provides a general exemption from the Buy American Act. The following examples illustrate the application of evaluation procedures in 25,502 and 25,503.
