What Does Reinstatement Eligibility Mean

If you have previously worked for the federal government as part of a career-related career or appointment, you may be eligible for re-employment. Reinstatement allows former federal employees to re-enter the federal government`s competitive workforce without competing with the public. Former federal employees can apply for any open public service exam, but re-employment eligibility also allows you to apply for federal positions that are only open to status applicants. People seeking re-employment often find it helpful to attach a copy of their public sector employment history to job applications. If you would like to receive a copy of your employment history, send a signed letter to the Work History Unit at the following address: Office of the Comptroller of State, P.O. Box 942850, Sacramento, CA 94250. Your letter should include your first/last name, date of birth, Social Security number, class and department where you last worked, approximate details of your work, and your current address and phone number. Individuals typically apply to agencies in response to vacancies advertised under the Performance Promotion Program. Some agencies only accept applications if they have a corresponding open earnings promotion, while others accept applications at any time. If you are aiming for a higher rank or a position with more potential for promotion than before, you will usually need to apply as part of a merit advertisement and be among the most qualified candidates to select.

Status applicants include individuals who are eligible for reinstatement. If you have already completed professional or career-related service with the federal government, you may be eligible for reinstatement. For existing employees, reinstatement rights are particularly interesting in reduction situations, where an employee is faced with the loss of a position through no fault of his or her own. One individual asked what research OPM had done to support the claim that the proposed rule would “benefit” both organizations and individuals seeking to re-employ the government. OPM believes the benefits to organizations are obvious: the regulations will give organizations more choice and the opportunity to rehire former federal government employees who have acquired skills that are enhanced or superior to those they acquired when they left government. Reinstatement allows you to re-enter the federal government`s competitive workforce without competing with the public. Reinstatement eligibility allows you to apply for federal jobs that are only open to applicants for status. Four individuals, a professional association, a federal agency and the federal employees` union stated that this proposed rule should also apply to current federal employees who have completed a year of service following a competitive appointment and who have been deemed at least fully satisfied with their most recent performance review. OPM cannot accept this recommendation. Current federal employees cannot be reinstated; Reinstatement is a personnel measure that applies to certain former federal employees.

The scope of the proposed Regulations related only to the reinstatement of former federal employees. OPM has amended the wording of paragraph 335.103(c)(3)(viii) of 5 CFR by inserting the words “prior to the application for reinstatement” to match the wording used in 5 CFR 335.103(c)(1)(vi). If you are eligible for reinstatement and wish to return to the federal public service, the reintegration program gives you an advantage that other applicants do not have. You must find vacancies and a score equal to or lower than the one you left the federal public service. The process is simple and described below. (viii) reinstatement in accordance with Part 315 of 5 CFR for any position within the Competition Service for which the person is qualified to a higher rank or has a higher potential for advancement than a career or position related to the career previously held by the person; provided that the person has been separated for at least one year before applying for reinstatement, and must have received a rating of at least full success (or equivalent) for their last career- or career-related position. You must have had a professional or career-related appointment at some point in the past. If this is the case, there is no time limit on eligibility for those who: prefer veterans or have earned a career by completing 3 years of essentially continuous commendable service.

(vi) Re-employment in a permanent or temporary position in a higher grade or with more potential for promotion than a previously permanent position in the Competition Service if the person did not wait 1 year or more after the termination of federal employment before applying for reinstatement, or no assessment for his or her last career or career-related position of at least fully successful (or equivalent) has been received. One person pointed out that the proposed rule was not in the best interests of the American people. OPM disagrees. First, we note that the proposed rule is a discretionary measure, but it is used, requires: the candidate must be readmitted to use it, meet the degree requirements and meet all the qualification requirements required for the position sought by the person. It also requires the organization to adhere to the principles of the merit system when using this power. On the basis of these safeguards, OPM considers that the proposed wording is in the public interest; It offers agencies greater choice by encouraging qualified former employees to apply, thereby improving performance. If you have not completed a required probationary period during the previous period of service as part of the date on which your right to re-employment is well-founded, in most cases you will be required to complete a full probationary period of one year after your reinstatement. CLARIFICATION: I suggest you contact all the agencies in your area that use your professional skills and send them an updated federal style resume with a copy of your latest SF-50 as mentioned above.

Also send a cover letter describing the job you are looking for, with a general introduction. Send the cover letter to the hiring manager, human resources manager or a specific manager in the unit where you wish to work. Contact your local Federal Executive Council (FEB) for a list of agencies in your area. Most FEB now have online web stables. One commenter asked whether this rule waived the three-year period for eligibility for re-employment in 5 CFR 315,401(b) for individuals who did not meet the requirement for a professional career. OPM does not waive the time limits set out in 5 CFR 315.401(b). Former career-related employees are entitled to re-employment for three years. Former professionals have the right to reintegration for life. One individual and three federal organizations asked OPM to clarify the term “recent” in relation to the use of performance evaluation of an individual`s last federal appointment. .
